ProShippingHub General Terms and Conditions of Carriage

Terms and Conditions

By entrusting a shipment to ProShippingHub, the “Sender”, on their own behalf and on behalf of the recipient (“Recipient”) and any interested third party, agrees to the application of these General Terms and Conditions of Carriage (“GTCC”).

“Shipment” means any document or package accompanied by a single waybill and which may be transported by any means ProShippingHub deems appropriate at its sole discretion, including air, road, rail, maritime transport, or any other carrier. “Waybill” refers to any shipment identification document produced by ProShippingHub or the Sender’s automated systems, such as a label, barcode, air waybill, or any transport document, including electronic versions.

ProShippingHub’s liability for each shipment is limited as set forth in this document. If the Sender requires additional protection, they may request insurance coverage by paying an additional fee (see Section 8). “ProShippingHub” refers to ProShippingHub Ltd. and its authorized logistics partners.


1. Customs Clearance and Regulatory Compliance

To perform shipping services, ProShippingHub may, on behalf of the Sender or Recipient:

  • Complete documents, modify product/service codes

  • Advance payment of customs duties, taxes, or penalties (“Customs Charges”)

  • Act as the Sender’s/Recipient’s representative for customs procedures

  • Redirect shipments upon request from authorized parties

The Sender/Recipient must provide all necessary authorizations for customs clearance.


2. Unacceptable Shipments

Shipments are unacceptable if they contain:

  • Weapons, ammunition, explosives, or replicas

  • Counterfeit goods

  • Cash, precious metal bullion

  • Live animals or protected animal parts (e.g., ivory)

  • Human remains or ashes without authorization

  • Drugs or illegal substances

  • Hazardous materials (ADR/IATA/ICAO)

  • Incomplete addresses or inadequate packaging

  • Senders/Recipients subject to international sanctions


3. Deliveries and Undeliverable Items

  • No deliveries to P.O. boxes

  • Delivery is made to the provided address, not necessarily to the named recipient

  • For centralized receiving addresses, delivery is made to the reception service

  • For unacceptable shipments or unreachable recipients:

    • We will attempt to return to Sender

    • Costs charged to Sender

    • In extreme cases: disposal/abandonment without liability


4. Inspection

ProShippingHub reserves the right to inspect any shipment for:

  • Security reasons

  • Customs compliance

  • Regulatory verification


5. Charges, Fees, and Surcharges

  • Rates based on actual or volumetric weight (whichever is greater)

  • Possible weight/dimension verification

  • Recipient may need to pay Customs Charges before delivery

  • If Recipient fails to pay, Sender is responsible for payment


6. Liability of ProShippingHub

6.1 Liability Limits

  • International air transport: 35 USD/kg (Montreal/Warsaw Convention)

  • International ground transport: 11 USD/kg (CMR Convention)

  • Domestic transport: 1 USD/kg

Indirect damages (lost profits, missed opportunities, etc.) excluded.

6.2 Delivery Times

Estimated delivery times are not guaranteed. No liability for delays.


7. Claims

  • Submit written claim within 30 days of pickup

  • One claim per shipment

  • Reimbursement limited per Section 6


8. Insurance

Insurance coverage available upon request:

  • Full value of goods

  • Excludes indirect damages and delays

  • Request via waybill or digital systems


9. Events Beyond Our Control

No liability for:

  • Natural disasters (earthquakes, floods)

  • Conflicts, wars

  • Strikes, embargoes

  • Pandemics

  • Cyberattacks

  • Intrinsic defects of goods


10. Sender’s Obligations

The Sender guarantees:

  • Compliance with laws (export controls, sanctions, customs)

  • Accuracy of provided information

  • Authorization for Recipient’s data processing

  • Proper packaging

  • No undeclared hazardous materials


11. Routing

Explicit acceptance of potential route deviations or intermediate stops.


12. Governing Law

  • Governed by USA law

  • Jurisdiction: [USA]

  • If any clause is invalid, others remain enforceable
